Notice of PURPA Hearing

 
Notice of PURPA Hearing. May 28, 2009.Cuivre River Electric Cooperative, (“Cooperative”) hereby gives public notice regarding the process to be followed by it in implementing the statutory directives in the Energy Independence and Security Act of 2007 ( EISA 2007), which amended the Public Utilities Regulatory Policies Act of 1978 (PURPA). EISA 2007 established new Federal standards under Section 111(d) of PURPA, which each non-regulated electric utility (such as the Cooperative) is required to consider and to “make a determination whether or not it is appropriate to implement such standard[s]” within certain defined time lines based on evidence collected from interested persons after public notice and hearing.
 
Cuivre River Electric Cooperative will hold a public hearing on May, 28, 2009 for the purposes of receiving verbal and written testimony and developing a written record concerning consideration of four new standards as set forth in the Energy Independence and Security Act of 2007, 16 U.S.C. §§2621(d) et seq.:
 
1.   Integrated Resource Planning, as set forth at 16 U.S.C. §2621(d)(16);
2.   Rate Design Modifications to Promote Energy Efficiency Investments, as set forth at 16 U.S.C. §2621(d)(17);
3.   Consideration of Smart Grid Investments, as set forth at 16 U.S.C. §2621(d)(16) [sic]; and
4.   Smart Grid Information, as set forth at 16 U.S.C. §2621(d)(17) [sic].
 
The public hearing regarding the above standards will begin at 5:00 p.m. and will be held at:

The hearing will be conducted in accordance with Cuivre River Electric Cooperative’s Rules for Consideration and Hearing Regarding the PURPA Standards set forth in the Energy Independence and Security Act of 2007 (“Rules”). A copy of the Rules is available for inspection and copying during regular business hours at the office of Cuivre River Electric Cooperative, 1112 East Cherry Street, Troy Missouri 63379. A copy of the Rules is also available per written request to the Cooperative. Any person desiring a copy of the Rules shall be responsible for the reasonable costs associated with reproduction of the Rules.
 
Pursuant to 16 U.S.C. §2631(1), the U.S. Secretary of Energy and any electric consumer of the Cooperative may participate in the hearing as an intervening party. To apply for status as an intervener, an application must be filed with the Cooperative by no later than April 28, 2009. Please refer to the Rules for details regarding the proper procedure for participating in or, limited appearances at the hearing, parties of record, submission of written comments, appearance and presentation of verbal testimony and applicable deadlines.
 
Associated Electric Cooperative, Inc. (AECI) is owned by and provides wholesale power to six regional generation and transmission cooperatives (G&Ts). AECI is the all-requirements provider of wholesale power to Central Electric Power Cooperative under the terms and conditions of the 1962 Electric Power Coordination Agreement until May 31, 2050. Central Electric Power Cooperative is the all-requirements provider of wholesale electric power to Cuivre River Electric Cooperative. For these reasons, the Cooperative may not be able to fully realize these standards as they may conflict with the all-requirements contractual agreement with Central Electric Power Cooperative. Parties participating in the hearing are strongly urged to take such limitations into account when presenting their views.
